ARCHITECTURAL COMMITTEE RULES

I. ON SITE VISIT

After purchase of a lot, and prior to the design of a home, the Lot Owner is required to arrange for an on-site visit involving the Lot Owner, a member of the Strawberry Hollow Property Owners Association Architectural Committee, (hereinafter referred to as ‘the Architectural Committee’), and an architect who is familiar with the Strawberry Hollow Architectural Rules. (This architect should be willing to perform this service free of charge.) The purpose of this on-site visit is to align the Lot Owner with the intent of the Architectural Committee, and to allow input from the Owner, the Architect and the Architectural Committee prior to the completion of the final plans, to discuss home placement, home design, colors, exterior lighting, tree cutting and clean up expectations in an effort to provide the Owner a savings in time and expense.

II. PRELIMINARY REVIEW OF ARCHITECTURAL PLANS AND SPECIFICATIONS

After the on-site visit, and once the Contractor and/or Architect have been selected for the construction of Owners home and/or other improvements on the Lot (hereinafter referred to as ‘the improvements’), the Lot Owner is required to arrange for a meeting with the Architectural Committee. At this meeting, the overall concept of Owners improvements should be presented, including any sketches or drawings. If selected, the Contractor should attend this meeting. The Contractor must be licensed in Arizona. Workman’s Compensation must be carried by all General Contractors and/or all its sub-contractors. The Owner may act as his/her own Contractor provided Workman’s Compensation is carried on all its workers. The Contractor must furnish its license number and expiration date to the Architectural Committee at this meeting, or upon selection.

The boundaries of the Lot and the improvements shall be identified by string for inspection by the Architectural Committee prior to this meeting. In the event lot corners cannot be identified, a survey will be required prior to this meeting. All trees property owner desires to cut must be ribboned and all such trees must first be approved for cutting, prior to any tree cutting, by the Architectural Committee. All exterior construction on the improvements must be completed within 180 days from Building Permit issuance date.

III. SUBMITTING OF BUILDING PLANS

Two copies of the final working drawings with specifications for the improvements, including Site Plan, must be mailed or delivered to the Architectural Committee. One copy will be retained for the Architectural Committee’s file and one copy, if approved, will be stamped ‘Approved’ and returned to the Lot Owner. Also, prior to commencement of construction, the selected Contractor must meet with Committee.

The final working drawings with specifications, when submitted, must include the following items:

a.) Letter by Owner requesting review and approval.

b.) A site plan showing Lot number, location of the improvements showing set-back requirements, utilities, trench location, driveway and off street parking locations and materials to be used.

c.) Working drawings to show grading, elevations, floor plan, livable square footage, deck and porch square footage, all exterior materials and colors (Owner to provide samples of materials and colors IF requested by Committee). Plans also to show building height in relation to the roadway, plus impact on natural drainage and surrounding existing homes. Plans to be clearly marked, “all exterior lighting to be indirect lighting”, meaning light source not to be visible from off-site.

d.) A landscape plan showing trees and shrubs to be planted, drainage away from improvements and watering system.

e.) Name, address, phone and fax numbers of Owner, Contractor, Designer/ Architect.

f.) Date of drawings.

g.) Elevations to show exterior dimensions.

h.) Design support as it relates to drainage, the site itself and to adjacent homes, if any.

i.) All improvements final drawings shall accompany a $2.00 per square foot of proposed construction clean-up and damage deposit, paid by Owner. This deposit is refundable upon satisfactory completion of improvements in accordance with the approved plans and Committee inspection, in whole or in part, for the cost of cleaning the Lot and adjoining properties or roads and repairing damage to the roads in the process adjoining properties or roads and repairing damage to the roads in the process of constructing said improvements. Liability is not limited to deposit.

IV. APPROVAL OF PLANS

After review of the above described plans submitted by the Lot Owner, the Architectural Committee will either approve in writing the plans submitted or request changes that may be necessary to assure that the proposed improvements are in harmony with the surroundings and are in compliance with the deed restrictions of the subdivision. The decision of the Architectural Committee shall be made no more than 30 days from date of receipt of all requested items herein stated as set forth in Section II. The Architectural Committee shall have the right to refuse approval of any plans or specification associated with the home, modifications, grading, drainage, landscaping or any other plans, which are not suitable, in the sole opinion of the Architectural Committee, for any reason. All decisions of the Architectural Committee are final.

V. VARIATIONS AND/OR MODIFICATIONS

Once plans and specifications have been approved by the Architectural Committee, any variation or modification to such approved plans must be approved in writing by the Architectural Committee prior to proceeding with construction. Committee will proceed to terminate any construction where a variation and/or modification has occurred without formal written approval by the Architectural Committee.

Approval by the Architectural Committee of any variation and/or modification to the original set of approved plans shall be acknowledged by letter to the Owner and registered on Committee’s approved set of plans.

VI. REFUND OF CLEAN-UP DEPOSIT

Upon completion of improvements and prior to Owner occupying improvements, Owner shall give notice to Committee, who shall then inspect the Lot and improvements for compliance with, but not limited to:

a.) The clearing of Lot and surrounding areas of all materials, debris and trash of any kind.

b.) All cut shrubs, trees and branches removed from site and any cord wood stacked, neatly.

c.) All street front drainage areas to be raked clean and restored, if damaged, to aesthetically pleasing and functional condition.

d.) All excess earth must be removed from the construction site and the Lot restored to a natural appearance, including all excavation materials, regardless of who did the excavating, on or off the Lot.

e.) All exposed metal must be painted a Committee-approved earth tone.

f.) Any and all damage to the surrounding properties and roads must be repaired to the approval and satisfaction of the Architectural Committee, regardless of the origin of such damage.

g.) That no variation or modification has occurred without the prior written approval by Committee, in regard to design, home placement, tree cutting, approved exterior colors, indirect exterior lighting and driveway materials and placement.

h.) That the improvements were completed within the time frame and in accordance with the Deed Restrictions and per approved Committee plans.

i.) Exterior indirect lighting means no bulb or part of bulb or source of light can be seen by others off site. All exterior lighting fixtures must be approved by the Architectural Committee prior to installation.

The refund of Owners deposit, all or in part, is contingent upon compliance of the herein stated criteria for refunding of deposit by Committee, and such decision shall be made solely by the Architectural Committee.

VII. PRELIMINARY WORK

Any preliminary work on a Lot prior to start of actual construction, including, without limitation, removal of undergrowth and/or trees, work on driveways, the building of patios or retaining walls or any other work, shall first require written Committee approval.

Note: Driveways, or a portion thereof, may be required to be concrete or asphalt, and this, at the sole discretion of the Architectural Committee.

VIII. REVISIONS TO THE EXTERNAL APPEARANCE OF THE HOME AND LOT

Any repairs, remodeling or revisions to the exterior of a residence or improvement, whether new construction or remodeling an existing improvement, must have the prior written approval of the Architectural Committee prior to commencing with any such work. Without limiting the foregoing, prior written approval shall be required for the painting or staining of the improvement's exterior, which shall change the color thereof.

IX. CHANGES AND ADDITIONS

Changes and/or additions to completed improvements must comply with the same requirements as for new construction, as set forth in these Architectural Committee rules.

X. CONSTRUCTION LIMITATIONS

New residences shall contain a minimum livable area of 1200 square feet. All square footage requirements shall be exclusive of decks, porches, breezeways and garages. Garages must be attached and such attachment to be approved by Committee, in writing.

New dwellings will be limited to a height of 30 feet in height from ground level. Basements shall be no higher than 9 feet as measured on the low side of the dwelling.

Culverts under driveways must be a part of each lot’s drainage system. Committee must approve culvert’s size and length prior to installation.
